Kitchen Owner Agreement
Effective Date: July 17, 2026
This Kitchen Owner Agreement (“Agreement”) is entered into between the kitchen owner (“you”, “Kitchen Owner”) and JiSK IT Solutions, operating Tastiomeal (“Company”, “we”, “us”). By listing a kitchen on the Platform, you agree to be bound by this Agreement.
1. Independent Relationship
You operate as an independent business. Nothing in this Agreement creates any employment, partnership, joint venture, agency, or franchise relationship between you and the Company.
2. Platform Role Only
Tastiomeal is strictly a digital listing and discovery platform. The Company does not:
- Prepare, sell, handle, or deliver food;
- Verify kitchens or their operations;
- Inspect or certify compliance;
- Process payments or transactions;
- Act as an intermediary between users and kitchens.
3. Full Responsibility of Kitchen Owner
You acknowledge that you are solely responsible for your business operations, including but not limited to:
- Food safety, preparation, and handling;
- Compliance with all applicable laws and regulations;
- Licensing, permits, and inspections;
- Accuracy of all listings and representations;
- Customer interactions and disputes.
Tastiomeal does not assume responsibility for any kitchen operations, compliance status, or business conduct.
4. No Liability Disclaimer
To the maximum extent permitted by applicable law, JiSK IT Solutions and Tastiomeal shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to:
- Your kitchen operations or services;
- Food quality, safety, or allergic reactions;
- Customer complaints or disputes;
- Regulatory violations or enforcement actions;
- Loss of revenue, data, or business opportunities;
- Use or inability to use the Platform.
Your use of the Platform and your business operations are entirely at your own risk.
5. Indemnification
You agree to fully indemnify, defend, and hold harmless JiSK IT Solutions, Tastiomeal, and its affiliates from any claims, liabilities, damages, losses, legal fees, or regulatory actions arising from:
- Your kitchen operations;
- Violation of laws or regulations;
- Content you upload or publish;
- Any disputes with users or third parties.
6. User Content License
You retain ownership of your content. However, by uploading content (including images, menus, descriptions, and listings), you grant Tastiomeal a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute such content for the purpose of operating the Platform.
7. Content Removal
The Company may remove, suspend, or restrict access to any listing or content at any time, with or without notice, for operational, legal, or safety reasons.
8. No Warranty
The Platform is provided on an “as is” and “as available” basis without warranties of any kind.
9. Dispute Resolution
Any dispute arising from or related to this Agreement shall first be addressed through good-faith negotiation. If unresolved, disputes shall be resolved through binding arbitration or a court of competent jurisdiction, as permitted by applicable law.
10. No Class Action
You agree that any dispute shall be resolved individually and not as part of a class, collective, or representative action. You waive any right to participate in class proceedings.
11. Governing Law
This Agreement is governed by the laws of the Province in which JiSK IT Solutions operates and applicable federal laws of Canada.
